Health Care Provider Sexual Abuse

Health Care Providers are supposed to help us when we are unwell. We trust them to look after us and we rely on their advice, treatment, and opinions. Unfortunately, sexual abuse does occur in healthcare settings and perpetrators can include doctors, psychologists, and massage therapists (amongst numerous other provider types).

Those who have been sexually assaulted by a health care provider often face difficulties over the course of their lives. There can be a significant loss of trust as the healthcare provider breached the trust they were given by their patient.  Survivors of sexual assault by health care providers often face difficulties seeking medical attention and forming healthy treatment relationships.  More broadly, survivors’ personal relationships and educational and employment paths can be disrupted.  They may also struggle with substance abuse issues.

Most health care providers are regulated in Ontario.  Survivors may wish to explore a professional complaints process (for example to the College of Physicians and Surgeons of Ontario, or the College of Massage Therapists of Ontario).  Pursing a criminal charge can be another option.  These avenues can be in addition to a civil lawsuit for monetary damages.

Understanding Health Care Provider Sexual Abuse

Health Care Provider sexual abuse cases often involve:

  • Doctors or other health care professionals exploiting their position of trust or authority to assault their patient.
  • Survivors grappling with shame, fear, or long-term psychological harm.
  • Institutions such as medical practices, hospitals, or massage clinics failing to act on complaints or warning signs or being vicariously liable for the actions of their employees or representatives.

.

How We Help Survivors

We help those who have experienced sexual assault by a health care provider with compassion and expertise by:

  • Discussing the survivor’s legal options including the professional complaints process.
  • Pursuing civil claims against perpetrators and institutions.
  • Advocating and seeking compensation for financial losses as well as access to counselling and support.
