Historical sexual abuse involves assaults that occurred in the past and many of our clients’ cases involve trauma that occurred decades ago. These cases highlight the enduring trauma caused by abuse and the importance of holding perpetrators accountable, no matter how much time has passed. 

Many survivors of historical sexual abuse have faced years of challenges in their lives. Their personal relationships and employment may have been affected. They may struggle with substance abuse issues. Often, survivors choose to explore a lawsuit later in their life when they come to process the impact of abuse that occurred many years before. 

In Ontario, section 16 of the Limitations Act provides that there is no limitation period for cases involving sexual assault.  The absence of a limitation period acknowledges that, for many survivors, it can take many years to fully process trauma and recognize the fully impact on one’s life.
