- A slip or trip on ice, a wet floor or a broken step at a store, condo or parking lot
- A fall on a city sidewalk or road that wasn't kept in repair
- A dog bite or animal attack
- A cycling or motorcycle crash caused by a driver
- Neglect or poor care in a nursing home or retirement residence
- An injury at a gym, sports league or recreational activity
If you are unsure whether you have a personal injury claim, contact us to discuss your circumstances. Your first consultation is free and confidential.

How Long Do I Have to Make a Claim in Ontario?
In most Ontario injury cases, you have 2 years from the date of the injury to start a lawsuit. Some claims need written notice much sooner, in as little as 10 days.
| Situation | Deadline | What you must do |
|---|---|---|
| Injury caused by a municipal sidewalk or road that wasn't kept in repair | 10 days | Give written notice to the municipality (Municipal Act, 2001, s. 44(10)). |
| Slip or fall on snow or ice on private property (store, plaza, condo, parking lot) | 60 days | Serve written notice on the occupier or snow removal contractor, in person or by registered mail (Occupiers' Liability Act). |
| Most other personal injury claims | 2 years | Start the lawsuit, usually counted from when you knew or should have known about the injury (Limitations Act, 2002). |
Missing a deadline can jeopardize your right to bring a claim. Courts may allow exceptions in certain circumstances; however, relying on an exception is risky.
Different limitation rules may apply to children, people who are not legally capable of starting a claim, survivors of sexual assault, survivors of certain other forms of sexual misconduct and victims of assault in some circumstances. Call us early, even if you think time has already run out.
What Can a Personal Injury Claim Pay For?
A personal injury claim aims to put you, as closely as money can, in the position you would have been in had the accident never occurred. Depending on the circumstances, compensation may cover:
- Lost income: wages you’ve already lost and earnings you’ll lose in the future
- Treatment costs: physiotherapy, surgery, medication, counselling and future care
- Help at home: attendant care and housekeeping you can no longer do yourself
- Pain and suffering: what the injury has taken from your daily life
- Family Law Act claims: in some cases, close family members may have the right to advance a claim on their own, including after a wrongful death
In many personal injury cases, an insurance company pays compensation rather than the individual who caused the injury. Drivers and many businesses carry liability insurance that may respond to these claims.

Personal Injury FAQ
How much does a personal injury lawyer cost in Ontario?
Most personal injury cases are handled on a contingency fee, so you pay no legal fee until your case ends, and no fee at all if nothing is recovered. Martin & Hillyer Associates’ maximum contingency fee for personal injury cases is 33%, plus disbursements. Disbursements are case expenses like court fees and medical reports, and we explain how they work in your case before you decide anything.
How long do I have to sue for a personal injury in Ontario?
In most cases you have 2 years from the date of the injury to start a lawsuit, under Ontario’s Limitations Act, 2002. Some claims need written notice much sooner: 10 days for an injury caused by a municipal sidewalk or road that wasn’t kept in repair, and 60 days for a fall on snow or ice on private property. Talk to a lawyer right away, even if you think you’ve missed a deadline, because exceptions sometimes apply.
Can I still make a claim if I was partly at fault?
Often, yes. Under Ontario’s Negligence Act, your compensation is reduced by your share of the blame. A lawyer can tell you how fault is likely to be split in your case.
Will my case settle, or will I have to go to court?
Most lawsuits in Ontario settle before trial. In a settlement, the other side pays an agreed amount and you end the lawsuit. If no fair offer comes, we can take your case to a judge or jury, but the decision to settle or go to court is always yours.
Am I suing a person or an insurance company?
In most cases, an insurance company pays the claim. Ontario law requires every car owner to carry auto insurance, and most businesses carry liability insurance for injuries on their property. The lawsuit names the person or business responsible, but their insurer usually pays.
What should I do right after an injury?
Get medical care and tell your doctor about your symptoms. If you can, take photos of where the incident happened as soon as you can, keep your receipts, write down witness names, and speak with a lawyer as soon as you are able. Getting legal advice early is always a good idea.
